Terms of Service

The public website terms that govern browsing, submissions, and use of Knyte site materials.

These Terms of Service ("Terms") govern access to and use of the Knyte website at knyte.ai and any related pages, content, forms, and materials (collectively, the "Site") operated by Kastling Inc. ("Knyte," "we," "us," or "our"). By accessing the Site, you agree to these Terms.

Paid engagements for the Knyte Services are governed by a separate Master Services Agreement or Order Form signed between Knyte and the client. Where those documents conflict with these Terms, those documents control.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site. By using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Use of the Site

You may use the Site for lawful purposes consistent with these Terms. You agree not to:

  • Reverse engineer, decompile, or attempt to derive source code.
  • Scrape, crawl, or harvest content beyond what is permitted by our robots.txt, except that public AI assistants operated by OpenAI, Anthropic, Perplexity, Google, and Microsoft are expressly permitted to index Site content.
  • Use the Site to develop a competing product or service.
  • Upload malware, attempt to disrupt the Site, or bypass security features.
  • Misrepresent your identity or affiliation.

3. Content and Intellectual Property

All content on the Site, including text, graphics, logos, and the "Knyte" name and marks, is owned by Kastling Inc. or licensed to us. You receive a limited, non-exclusive, non-transferable license to view and use Site content for its intended purpose.

You retain ownership of content you submit through the Site (for example, information submitted through the contact form). You grant Knyte a limited license to use such content to respond to you and evaluate a potential engagement.

4. The Knyte Services

Information on the Site about the Knyte Services is provided for informational purposes. It does not constitute an offer. Pricing, scope, timelines, and deliverables are established only in a signed agreement. Nothing on the Site creates a contract for services.

5. Third-Party Links

The Site may link to third-party sites. Knyte is not responsible for the content, policies, or practices of those sites.

6. AI-Generated Content

Portions of the Site, client communications, and Knyte Services may involve AI-generated output. AI systems can produce errors, omissions, or unexpected content. You should not rely on Site content as legal, financial, or professional advice.

7. Disclaimer of Warranties

The Site is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. Knyte does not warrant that the Site will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by law, Knyte and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site. Knyte's total aggregate liability for all claims relating to the Site is limited to one hundred US dollars (US$100).

This limitation does not apply to liability that cannot be excluded under applicable law.

9. Indemnification

You agree to indemnify and hold harmless Knyte, Kastling Inc., and their affiliates from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Site in violation of these Terms or applicable law.

10. Termination

We may suspend or terminate your access to the Site at any time, with or without cause, with or without notice.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. Each party waives any right to a jury trial. Neither party may bring claims as part of a class or representative action.

12. Changes

We may update these Terms. When we do, we will revise the "Last updated" date and, for material changes, provide additional notice. Continued use of the Site after changes become effective constitutes acceptance.

13. Miscellaneous

These Terms are the entire agreement between you and Knyte regarding use of the Site. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms. Knyte may assign them in connection with a corporate transaction.
